Do You Need a Permit for a Dumpster in Your Huntsville Driveway?

The 30-second answer
- • Driveway placement? No permit needed in Huntsville, Madison, or anywhere in Madison County.
- • Street or right-of-way placement? Yes — you (or we, on your behalf) need a Right-of-Way permit from Huntsville Public Works.
- • HOA-managed neighborhood? Check HOA rules separately — those are not city permits but they can still bite you.
When you don't need a permit
If the dumpster sits entirely on your own property — driveway, yard, behind the house — the city doesn't require a permit. This covers the vast majority of residential dumpster rentals in Huntsville and Madison. It's your property, you can put a dumpster on it.
Practical implication: when you book through Tilt, we drop a pin on your driveway during checkout and confirm the placement fits. If your driveway can accommodate the size you ordered, you're done. No paperwork.
When you do need a permit
You need a Right-of-Way (ROW) permit any time the dumpster will sit on:
- The street in front of your house
- The strip of grass between sidewalk and street (the "right-of-way")
- The sidewalk itself (rare, and usually requires extra signage)
- Any public alley
The ROW permit is what lets the city know there's an obstruction in the right-of-way so emergency services, garbage pickup, and street maintenance can plan around it. It's not optional — if you place a dumpster in the street without one and someone reports it, the city can cite you and order it moved immediately.
How to get a Huntsville ROW permit
Contact: City of Huntsville Public Works
Phone: (256) 883-3944
What you'll typically need to provide: the address, the requested placement location, the dumpster size, and the rental duration. Permits are usually issued within 1–3 business days. Some placements (near intersections, on busy streets) require additional safety signage which Public Works can specify.
Cost varies by duration and location. As of 2026, simple residential ROW permits are typically under $50. The city publishes its right-of-way permit requirements on huntsvilleal.gov if you want the official fine print.
Madison and Madison County rules
Same general framework. Driveway placement doesn't need a permit. Street or ROW placement does. For Madison, contact:
City of Madison Public Works — call the main city number, (256) 772-5600, and ask for Public Works.
For unincorporated Madison County (Harvest, Toney, Hazel Green, parts of Meridianville), you're generally under county jurisdiction rather than a specific city. Most county roads don't require permits for short-term placements, but call the Madison County Commission at (256) 532-3492 if you're unsure.
HOA gotchas
HOAs are not the city. Even if a permit isn't legally required, your HOA may have rules about:
- Maximum days a dumpster can sit visible
- Required notification to the HOA office
- Approved placement (driveway only, not yard)
- Requirement for the dumpster to be covered overnight
Check your HOA's covenants document before booking. The fines for HOA violations can be much larger than a city permit fee and they're much harder to argue.
Does Tilt handle the permit for me?
For driveway placement (the majority of bookings) — there's no permit needed, so nothing to handle.
For street/ROW placement — yes, we can pull the permit for you as part of the booking. There's a $25 admin fee on top of the city's permit cost, and lead time bumps from next-day to 3–5 business days while we wait for the permit to issue. If you're in a hurry, you can pull it yourself faster by calling Public Works directly.
Bottom line
Most Huntsville and Madison residential dumpster rentals don't require any permit because they sit on your driveway. If you need to put a dumpster in the street, plan ahead for the permit (1–5 business days). If you live in an HOA neighborhood, glance at the covenants before booking to avoid a $200 fine that's steeper than the rental itself.
